If my neighbor shoots off fireworks and they damage or catch my home on fire, who’s homeowners insurance responsible?
Your homeowners insurance will pay. If the insurance company finds your neighbor negligent, your homeowners insurance company will subrogate.
Subrogation is the substitution of one party for another. Insurance companies typically have subrogation rights, so if the insurer pays the property owner for a loss, such as a house fire, and then discovers that the loss was the fault of a third party, the insurance company may sue and recover from the third party.
