Common Fireworks Insurance Question

July 2, 2010 By Nibby Priest

Fireworks_MLawrence_Gleaner[1] If my neighbor shoots off fireworks and they damage or catch my home on fire, who’s homeowners insurance responsible?

Your homeowners insurance will pay. If the insurance company finds your neighbor negligent, your homeowners insurance company will subrogate.

Subrogation is the substitution of one party for another. Insurance companies typically have subrogation rights, so if the insurer pays the property owner for a loss, such as a house fire, and then discovers that the loss was the fault of a third party, the insurance company may sue and recover from the third party.

Be safe this 4th of July Holiday.

Our office will be closed on the 4th of July -we do have a licensed insurance agent on call 24/7 for any emergency-related claims.
